Information on this site

We write the site to be accurate and current, but its content is general information about our products and about assessment practice. It is not legal, regulatory, psychometric or professional advice for your program, and it does not create a client relationship.

Guides, checklists, glossary entries and examples are working aids. Example engagements are labeled as examples and describe scenarios, not past clients. Decisions about accreditation, legal compliance or the defensibility of a score rest with the bodies and courts that make them; nothing on the site promises any of those outcomes. Please consult your own counsel and advisers about your obligations.

Prices and estimates are indicative

Prices on the site are indicative starting prices in U.S. dollars, before tax. They are not an offer, a quote or a commitment to sell at that price. The price you pay is set only in a signed proposal or agreement, which is fixed-fee and itemized.

The session cost estimator and any other calculator on the site produce indicative figures from published starting prices. They run in your browser, and their results are estimates for planning only. We may change prices, programs and services on the site at any time without notice.

Our content and marks

The site and its content, including text, illustrations, logos, page designs and code, belong to Exampit or its licensors and are protected by copyright, trademark and other laws. “Exampit” and the Exampit logo are our marks.

You may view, print and share links to pages for your own information. You may copy our guides and checklists for internal use within your organization to plan or review your own programs, provided you keep the Exampit attribution and do not change their meaning. You may not sell, republish or redistribute site content as a whole or in substantial part, use it to build a competing product, or use our name or logo in a way that suggests we endorse you, without our written permission.

Acceptable use

When you use the site, you agree not to:

• break any law or anyone’s rights, including privacy and intellectual property rights;
• try to gain access to any part of the site, our platform or our systems that is not meant for you;
• probe, scan or test the security of the site, except as part of a good-faith report described below;
• send malware, spam, or automated requests that place an unreasonable load on the site;
• scrape or copy the site in bulk, except by search engines that respect our robots.txt file;
• submit false information, or someone else’s personal data without their permission, through our forms; or
• try to obtain, share or sell exam content belonging to any testing program.

If you believe you have found a security weakness, tell us at legal@exampit.com. Please do not access, change or keep data that is not yours, and give us a reasonable time to fix the issue before telling anyone else. We may suspend or block access to the site for anyone who breaks these rules.

What you send us

Personal data you send through the site is handled as our privacy policy describes. Please do not send confidential exam content, candidate records or sensitive personal data through our contact or demo forms; if we need them, we will arrange a secure route.

If you send us suggestions or feedback about the site or our products, we may use them without any obligation to you.

Links to other sites

The site links to outside sources, such as research papers and standards bodies, so you can check our references. We do not control those sites and are not responsible for their content, availability or privacy practices. A link is not an endorsement.

Disclaimers

The site is provided “as is” and “as available.” To the fullest extent the law allows, Exampit disclaims all warranties about the site, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the site will be uninterrupted, error-free or free of harmful components, or that its content is complete or current at every moment.

These disclaimers do not affect any warranty Exampit gives a client in a signed agreement.

Limits on our liability

To the fullest extent the law allows, Exampit and its members, employees and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site or your reliance on its content. Our total liability for any claim relating to the site is limited to one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain warranties to be disclaimed or certain damages to be limited. In those places, these limits apply only as far as the law permits.

Governing law and venue

These terms are governed by the laws of the State of New Mexico, without regard to its conflict of laws rules. Any dispute arising from these terms or the site will be heard only in the state or federal courts located in Bernalillo County, New Mexico, and you and Exampit agree to the jurisdiction of those courts.

Changes and general terms

We may update these terms from time to time. The new version takes effect when we post it here with a new effective date, and your continued use of the site means you accept it.

If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver of it. These terms are the whole agreement between you and Exampit about your use of the site, and you may not transfer them without our consent.
